Where to file a military divorce if you or your spouse is on active duty

A long distance divorce can be challenging and trying because of the jurisdiction issues. It is important to have a home state as the jurisdiction for your military divorce. The law also requires active duty military personnel to consent to the dissolution upon being presented with a summons. This special law, the Servicemembers Civil Relief Act (SCRA), also allows service members stationed in the United States to live in one state but claim another state as their legal residence.

In addition to the divorce itself, you may also be concerned about the status of your or your spouse service member's benefits and pay as they can impact child support and alimony payments. The Uniformed Services Former Spouse Protection Act (USFSPA) was enacted to deal with these very concerns:

  • The act allows state courts to broadly construe pay as either just the service member's pay or as joint property for the spouse and the service member.
  • The federal laws also prohibit the division of military member's retirement to a spouse unless they have been married for more than 10 years.
  • California laws prevent a combined child support and spousal support determination from exceeding 60 percent of the military member's pay and allowances.
