Modification to Spousal Support

Inland Empire, California, Divorce Modification Lawyer

Spousal support or alimony, similar to child support, may provide you the basis for living life as you did during your marriage. In that case, changed circumstances may provide the basis for requesting an increased alimony payment. On the other hand, you may be looking to stop making alimony payments. Changes to a spousal support award post divorce may be necessary in the following circumstances:

  • Changed job or position
  • Increased or decreased salary
  • Being fired or laid off from job
  • Changed circumstances, including the cost of living
  • Changed California divorce law
  • Cohabitation with another person
  • Marriage to another person

I'm Lenita Skoretz, and I represent clients on both sides of a spousal support modification. Contact me, a skilled family law attorney, to discuss your alimony modification.

Stopping alimony payments to your ex-spouse

If you are trying to stop paying alimony, it's likely because your ex-spouse's situation has changed or your situation has changed. If your ex-spouse got a job, and no longer needs the support, or your ex-spouse has not notified the court of a new marriage, you may be able to get approval to stop paying. You may also get court approval of the modification if your desire to decrease the amount of spousal support if a change in employment has hurt your ability to make payments.

Regardless of the reason you want to stop paying alimony, you need to go to court. Do not simply stop making the payments or you will be in violation of a court order and could go to jail. I can assist in preparing the necessary documents to demonstrate the reason to decrease or stop alimony payments. I will also counsel you on the type of proof required to demonstrate changed circumstances of your ex-spouse or you.

Requesting modification for an increase in spousal support award

If you need an increase in your alimony award, you will need proof of the reason for the request. In all cases involving a modification to an existing court order, you will need to go to court to get the modification legally approved.
