Inland Empire, California, Visitation Modification Attorney
There are several reasons that you may be considering a request for a change in your child's custody. Custody modifications are not easily granted by the court. Any request to change custody must be in the best interest of the child. A court will consider changes to the child custody and visitation provisions for the following reasons:
- Parent's changing work schedules
- A change in schools making it easier for the child to live with one parent or the other
- The request of an older child to live with the other parent
- Parental relocation (move away)
- Physical or sexual abuse by a parent

Child custody and visitation modification process
Don't think that an agreement between parents to change a child's physical custody is enough. Many parents later change their mind or argue that they never agreed to a custody change. You need to go to court for a legal change in the original custody order. An attorney can help you recognize the potential problems in modifying the original agreement, including consequences to your legal and physical custody rights.
A modification to child custody or visitation will only be granted if such a change is in the best interests of the child. It is the court's discretion whether to grant a custody modification. A change in custody is also going to impact your child support award. If the primary custodian is changed, the custodian will not receive the same child support award.
Child custody modifications are necessary for move-aways
Any parent who is subject to a child custody order and who is also looking to relocate with the child must secure court approval before doing so. An experienced family law attorney can help you seek a modification in your child custody or visitation order because of a move away or relocation. It is important to get court approval before relocating so you don't violate the child custody order and in turn, negatively impact the current custody arrangement.
