Are legal separations still valid under California law? In a word, yes. A legal separation is a legally recognized agreement to begin the process of child custody arrangements and division of marital property.
Legal separations are viable options for people whose religions convictions do not recognize divorce as an option.
Essentially, the courts recognize the separated couple as “divorced,” even if other social institutions do not. Legal separations are most common for spouses in long-term marriages who may rely on remaining legally married for the purposes of receiving corporate benefits such as health insurance.

If you ever intend to get remarried, you will have to eventually have your marriage ended by divorce. The California courts do not recognize separation as a final dissolution. Separation can be a major time-saver, however, if you intend to move quickly with your divorce. By filing for separation, the legal processes that usually occur during the six-month divorce waiting period can move forward more quickly.
